LEMON TOUR – LEMON EXPERIENCE

1. PRESENTATION

The sole proprietorship Di Lieto Antonietta, whose registered and main office is located at Località Annunziata, 6 – 84010 Minori (Salerno), Italy, P. IVA/C.F. 06160130651, operates under the trade name “Sotto i limoni – Cooking classes & Lemon tours”(hereinafter, Sotto i Limoni) and offers the commercial services listed in Paragraph 2.

The mission of Sotto i Limoni is to enrich the stay of visitors to the Amalfi Coast by offering services that enable a close connection with the territory, its culture, and its traditions. The vision is the reinforcement and growth of the tourism sector on the Amalfi Coast.

As one of the few similar operations in the region, Sotto i Limoni presents its services within a completely new and stimulating context, distinguishing itself from other providers through its local distinctiveness. This unique profile is derived from the location (the services are carried out in an authentic local home, set against the backdrop of the Amalfi Coast), the origin of the products (sourced directly from its own agricultural vegetable garden), and the specialized staff.

The objective is to bring guests closer to the local culture and culinary tradition, allowing them to comprehend their unique characteristics and enabling them to replicate them fully independently.

2. TYPES OF SERVICES

The services offered consist of the following:

• cooking experience: educational and training opportunities consisting of the preparation of dishes, with the assistance of designated personnel, utilizing gastronomic products and with the aid of specific equipment;
• pizza experience: educational and training opportunities consisting of the preparation of pizzas with the assistance of designated personnel, or the demonstration of the necessary stages to be followed for the preparation of the dough and the food items with which to top the pizza prior to baking in the wood-fired oven or immediately thereafter;
• lemon tour or lemon experience: a guided tour of the PGI (Protected Geographical Indication) lemon grove, during which lemon cultivation techniques, the history of our agricultural estate, and the daily use of lemons are illustrated.

Depending on specific requirements and upon explicit request, as well as at the sole and absolute discretion of Sotto i Limoni, alternative services appropriately and specifically organized for the occasion may be offered.

The amount paid at the time of booking represents solely and exclusively the consideration for the training activity offered by Sotto i Limoni, excluding any provision of food and beverages, except as provided in paragraph 11.
Any consumption of food by one or more participants in the booked experience is done freely and voluntarily by each participant, excluding any provision of food and/or beverages other than those provided for in paragraph 11, and releasing Sotto i Limoni from any liability that may arise therefrom.

2.1 Cooking experience

The cooking experience is a training activity aimed at transmitting to participants the methods of preparing traditional local dishes. It is organized into two main sessions: the morning session, starting at 10:30 AM Rome time, or the afternoon session, starting at 6:30 PM Rome time. Each session has a duration of approximately 3 (three) hours.

Sotto i Limoni reserves the right to limit the offering to a single daily session, alternatively either the morning or the afternoon session. Generally, during the period from June 15 to September 15 and, in any case, at the absolute discretion of Sotto i Limoni, only the afternoon session is offered.

The number of participants for each session varies, starting from a minimum of 2 (due) individuals. These sessions may be conducted in either of the following formats:

• Shared format: in which case the session is open to bookings from third parties; or
• Private format: in which case the session is strictly reserved for the participating individuals expressly indicated by Sotto i Limoni.

In any case, Sotto i Limoni reserves the right, at its sole and unappealable discretion, to deny any request aimed at binding a session to either a shared or private format.

Sotto i Limoni reserves the right to offer other types of experiences upon request or on its own initiative, providing appropriate and timely notice to the participants.

2.2 Pizza experience

The pizza experience is a training activity aimed at transmitting to participants the methods of preparing pizza. It is organized into two main sessions: the morning session, starting at 10:30 AM Rome time, or the afternoon session, starting at 6:30 PM Rome time. Each session has a duration of approximately 3 (three) hours.

Sotto i Limoni reserves the right to limit the offering to a single daily session, alternatively either the morning or the afternoon session. Generally, during the period from June 15 to September 15 and, in any case, at the absolute discretion of Sotto i Limoni, only the afternoon session is offered.

The number of participants for each session varies, starting from a minimum of 2 (due) individuals. These sessions may be conducted in either of the following formats:

• Shared format: in which case the session is open to bookings from third parties; or
• Private format: in which case the session is strictly reserved for the participating individuals expressly indicated by Sotto i Limoni.

In any case, Sotto i Limoni reserves the right, at its sole and unappealable discretion, to deny any request aimed at binding a session to either a shared or private format.

Sotto i Limoni reserves the right to offer other types of experiences upon request or on its own initiative, providing appropriate and timely notice to the participants.

2.3 Lemon tour

The lemon tour consists of a guided tour of the agricultural land located at the principal place of business of Sotto i Limoni, which features an estate dedicated to the cultivation of the “Limone Costa d’Amalfi IGP” (Amalfi Coast Lemon PGI). The guided tour takes place with the participation of the owners of the agricultural land, who illustrate lemon cultivation techniques, the tradition of lemon farming in Minori, the history of the lemon grove, as well as the potential applications of lemons in everyday activities.

The lemon tour is generally organized into two main sessions: the morning session, starting at 10:00 AM Rome time, or the afternoon session, starting at 6:00 PM Rome time. Each session has a duration of approximately 3 (three) hours. Sotto i Limoni reserves the right to limit the offering to a single daily session, alternatively either the morning or the afternoon session. Generally, during the period from June 15 to September 15 and, in any case, at the absolute discretion of Sotto i Limoni, only the afternoon session is offered.

The organization of a session at different hours or through alternative modalities is not precluded, remaining at the full and total discretion of Sotto i Limoni, as well as the owners of the agricultural estate.

3. PLACE OF PERFORMANCE OF THE SERVICES

The services are performed at the principal place of business of Sotto i Limoni, located in Località Annunziata, 6 – 84010 Minori (SA), Italy. Services may also be performed at secondary, temporary, or permanent locations; in such cases, it shall be the responsibility of Sotto i Limoni to specify in the booking document the precise venue where the booked experience will take place.

Access to the location occurs primarily through public spaces or spaces open to the public, regarding which—without this constituting a statutory or regulatory obligation—appropriate information is provided on the website www.sottoilimoni.com/location. In any event, by submitting a booking request to Sotto i Limoni, the applicant certifies that they are fully aware of the principal location where the requested services will be performed.

In any case, the delivery of the booking document by Sotto i Limoni fulfills the organizer’s obligation to inform clients of the exact position where the booked services will be performed.
This informational obligation is considered fulfilled with respect to all participants upon the transmission of the booking document to the group leader or the designated contact person for the booking. In the case of requests and bookings made by agencies, the aforementioned informational obligation is fulfilled by Sotto i Limoni via the delivery of the booking document to the agency, which shall then fully assume the obligation to inform the individual participants of the experience.

It is the personal responsibility of each participant to familiarize themselves with the access routes and means to reach the designated meeting point (“meeting point”) indicated on the booking document, thereby releasing Sotto i Limoni from any liability whatsoever should personal, logistical, or health-related circumstances arise that hinder or prevent the participant from reaching the meeting point or the place of service performance.

4. MATERIALS USED

The food products utilized in the performance of the services may be:

• locally sourced: meaning cultivated directly by the Sotto i Limoni Agricultural Farm or by the owners of the agricultural land comprising the principal place of business or any secondary locations; or
• purchased: from local or regional vendors or, alternatively, on the open market, taking diligent care to select the highest quality products available.

For the execution of the activities specified within the scope of the services under Paragraph 2, Sotto i Limoni shall temporarily provide—strictly limited to their employment within the activities of the booked and performed service—the necessary tools and equipment. Guests shall bear the strict obligation to exercise due care over such items and shall be held liable for their integrity pursuant to Article 2051 of the Italian Civil Code (custodian’s liability).

5. FOOD ALLERGIES AND/OR INTOLERANCES

Sotto i Limoni guarantees that the products made available during the performance of the booked services are of high quality, taking care to select the best available products according to feasible timelines and operational modalities.

At the time of the initial request, throughout the booking procedure, and up until the exact moment of service performance, the applicant—and, through their mediation, each individual participant in the experience, or the booking agent acting on their behalf—has the absolute duty to inform Sotto i Limoni of any medical conditions or health statuses that may affect the regular
enjoyment of the booked service. This includes, by way of example and without limitation, any food or non-food allergies and/or intolerances affecting any participant in the course.

In the absence of clear communication to Sotto i Limoni regarding any such conditions, the booking contact person—and, through them, the participants in the experience, or the agent proceeding with the booking on their behalf—shall completely release the organizer from any and all liability arising from the voluntary or involuntary ingestion or exposure to any such products, whether food or non-food items.

6. BOOKING PROCEDURE

The booking of a service is governed by a specific procedure:

The client—and, through them, the members of their group, or the agent acting on their behalf —shall submit a request through two alternative channels:

• in written form, by filling out and submitting the digital form available in the “Book” section of the website www.sottoilimoni.com; or
• in written form, via electronic mail addressed to info@sottoilimoni.com.

Any requests transmitted via other communication channels shall be deemed merely preparatory to subsequent email confirmation. Sotto i Limoni nevertheless reserves the right to regulate the booking procedure differently on a case-by-case basis according to specific needs and contingencies.

Sotto i Limoni ensures the delivery of a timely response to the applicant via electronic mail to the email address used for the information request, which is presumed to belong to or be at the full disposal of the applicant.

In order to proceed with the provisional confirmation of the booking, the payment of a deposit is required as an integral part of the total amount due. The deposit paid to Sotto i Limoni is refundable strictly in accordance with the applicable cancellation policy, which is communicated to the applicant and, through them, to the group members or the agent acting on their behalf.

Once the requested information is received and the deposit is paid, Sotto i Limoni shall issue a booking document constituting definitive confirmation of the booking made. This document shall specify: a) the full name of the applicant, designated as the group leader for the booking; b) the number and category of participants (e.g., adults, youth, children); c) details of the
booked experience; d) total amount due, total amount paid, and the remaining balance to be paid; e) the applicable cancellation policy; f) the precise indication of the venue where the booked services will be performed; g) a formal notice on the necessity to disclose health conditions that may impact the regular course of the service (e.g., food allergies and/or intolerances); h) an emergency contact telephone number. The document is delivered to the booking party, recognized as the group leader, and, on their behalf, also to the members of their booking group or the agent, utilizing the email address provided during the booking phase. It is the sole duty of the group leader or the agent to inform all other participants of the exact details of the booking.

Should any further necessary clarifications be required, the booking group leader, each individual participant, and the agent are warmly invited to bring such matters to the attention of Sotto i Limoni by sending an email to info@sottoilimoni.com.

7. PRICES

Prices are determined at the sole and unappealable discretion of Sotto i Limoni in accordance with the periodically updated price list, which may be consulted upon request by sending an electronic mail message to info@sottoilimoni.com. The application of any discounts and promotional rates remains subject to the exclusive judgment of Sotto i Limoni.

The prices in the quotations sent to agencies or intermediaries, whatever their name, are confidential to them and are covered by commercial secrecy (artt. 98 e 99 Intellectual Property Code).

8. PAYMENT

Payment for the performance of the requested services may be executed via two distinct
modalities:

• Single payment: through the settlement of the entire amount due, inclusive of any additional charges related to the use of specific payment instruments or invoicing, by a deadline prior to the booked date and specifically designated within the booking document or electronic correspondence;
• Separate payments: through the advance payment of a deposit, by a deadline prior to the booked date and specifically designated within the booking document or electronic correspondence, followed by the payment of the remaining balance. Both transactions shall include any additional charges linked to the use of specific payment instruments or invoicing.

The balance may be settled either in advance, by a date prior to the booked date specified in the booking document/correspondence, or directly on site.

The failure to pay, whether in whole or in part, the total booking amount within the prescribed deadlines shall constitute an absolute bar to the correct execution of the booked event. In such event, the applicant—and, through them, the members of the booking group, or the agent acting on their behalf—shall forfeit any right to the refund of any amounts already paid.

Where the modality of paying the balance on site is selected, the payment of the deposit shall constitute full acceptance, by the applicant, the group members, and the agent, of these terms and conditions of service performance, as well as the strict obligation to comply with the cancellation policy, thereby legally binding them to pay any difference between the deposit already settled and
the amount required as a cancellation penalty.

In the event that on-site settlement of the balance is chosen, such payment may be performed via the following instruments:

• cash;
• valid credit and/or debit cards belonging to the payment networks accepted by the payment
• terminal in use;
• instant bank transfer;
• any other forms of instant digital payment expressly accepted by Sotto i Limoni.

9. CANCELLATION POLICY

The person making the booking and, through him, each member of the booking group or, on their behalf, the agent can always proceed with the cancellation of the booking.

The cancellation of a booking entails the application of contractual penalties to be borne by each participant or, on their behalf, by the Agency.

Cancellation performed up to the sixteenth (16th) day prior to the booked date, before 11:59:59 PM Rome time, shall not attract any cancellation penalty. In cases where a confirmation deposit has already been paid, Sotto i Limoni undertakes to refund the amounts received, net of any processing fees or bank commissions applied to the refund procedure by the banking or financial
institutions utilized for payment management.

Early-Stage Cancellation – Cancellation performed between the fifteenth (15th) day and the eighth (8th) day prior to the booked date, before 11:59:59 PM Rome time, shall result in a cancellation penalty equal to 30% of the total gross amount due for the booking. This amount may correspond to the guarantee deposit requested during the booking phase.

Advance Cancellation – Cancellation performed between the seventh (7th) day and the third (3rd) day prior to the booked date, before 11:59:59 PM Rome time, shall result in a cancellation penalty equal to 50% of the total gross amount due for the booking. If a portion of the total due has already been deposited as confirmation, such amount shall be retained as an integral part of the applied cancellation penalty. The booking party—and, through them, the group members or the agent—remain bound to fulfill the obligation assumed at booking, consisting of the subsequent settlement of the difference between the confirmatory deposit and the percentage of the total due prescribed as a penalty. Failure to settle the sums due may give rise
to legal actions for damages under current laws.

Final-Stage Cancellation – Cancellation performed between the third (3rd) day and the day of the booking itself shall result in a cancellation penalty equal to 100% of the total gross amount due for the booking. If a portion of the total due has already been deposited as confirmation, such amount shall be retained as an integral part of the applied cancellation
penalty. The booking party—and, through them, the group members or the agent—remain strictly bound to subsequently settle the difference between the confirmatory deposit and the full total due. Failure to settle the sums due may give rise to legal actions for damages under current laws.

No-show – The failure to appear by the booking party and any individual participant for the booked experience shall result in a penalty equal to 100% of the total gross amount due for the booking. If a portion of the total due has already been deposited as confirmation, such amount shall be retained as an integral part of the penalty. The booking party—and, through them, the group members or the agent—remain bound to subsequently settle the full difference. Failure to pay the sums due may give rise to legal actions for damages under current laws.

In any case, the cancellation policy as explicitly stated on the booking document shall prevail. The receipt of such document by the booking party, the group members, or the agent certifies the full examination and acknowledgement by said subjects of the specific cancellation policy applicable to the booking they have arranged.

Due to supervening and unforeseeable natural disasters, and in any case, at its sole discretion, Sotto i Limoni may grant:

• not to proceed with the payment of outstanding amounts;
• to refund the confirmation deposit, in cases where a legitimate refund is not provided;
• to issue a voucher for an amount equal to the outstanding amounts or the total booking amount, to be used within a deadline set by Sotto i Limoni.

For supervening reasons, Sotto i Limoni may decide to cancel one or more reservations for one or more sessions at any time, promptly notifying the person making the reservation/group leader and, through them, each participant or, on their behalf, the agent. Unilateral cancellations by Sotto i Limoni, except in cases where any liability may be attributed to each participant or, on their behalf, the agent, will always result in a refund of the amounts already paid, net of any bank or other fees.

10. SALE OF SERVICES

Entities authorized to sell the services offered by Sotto i Limoni must possess the formal approval of the latter, which renders them qualified to sell the services offered by Sotto i Limoni, without prejudice to the absolute right of Sotto i Limoni to prohibit any specific subject from carrying out mediation or brokerage activities on its behalf.

Sotto i Limoni shall not be held liable under any circumstances for any booking fees, surcharges, or service fees applied by travel agencies and/or companies engaged in the sale and/or production of tourist packages or tourist services, recognized under any title by their country of residence or business operation, without prejudice to the professional courtesy of said agencies and companies
to inform Sotto i Limoni of the final price applied to the end consumer.

Sotto i Limoni is not engaged, within the execution of its services, in any promotional or marketing activities on behalf of third parties, whether free of charge or for consideration, except in cases of its own promotion on specific platforms for the intermediation and sale of tourist services.

11. SAFEGUARD CLAUSE

Sotto i Limoni may offer self-service catering for immediate on-site consumption, using products derived exclusively from the company’s own agricultural raw materials, in full compliance with Article 4 of Legislative Decree No. 228 of May 18, 2001, regarding the orientation and modernization of the agricultural sector. The business is operated in full compliance with the law, excluding any catering or assisted table service, and using only the facilities and furnishings within the company made available for independent use by patrons.

12. CONFIDENTALITY OF COMMUNICATIONS

Documents produced, sent, and forwarded by Sotto i Limoni by any means of communication are for the exclusive viewing of the recipient and booking participants. These documents are considered the property of Sotto i Limoni and their unauthorized reproduction, distribution, and/or publication is prohibited.
The information, data, and notices contained in correspondence, including electronic correspondence, and related attachments are of a private nature and, as such, may be confidential. They are, in any case, intended exclusively for the indicated recipients and booking participants.
The dissemination, distribution, and/or copying of correspondence, including electronic correspondence, of this and other transmitted documents by any person other than the recipient is prohibited, pursuant to Article 616 of the Italian Criminal Code and Regulation (EU) 2016/679 and Legislative Decree No. 196/2003 and subsequent amendments and additions.

13. LANGUAGE

The consumer agrees that, in any case, the Italian language version of the terms and conditions governing the provision, use, and enjoyment of the services offered by Sotto i Limoni is the only authoritative text. Any language versions other than Italian are provided solely as a courtesy.
