Art. 4 – Use of the website and user’s responsibility
1. Access to and use of the website, viewing of web pages, including communication with the operator, the possibility of downloading information on products and purchasing them on the website, are activities carried out by the user exclusively for personal use unrelated to any commercial, entrepreneurial or professional activity.
2. The user is personally responsible for the use of the website and its content. The operator cannot be held responsible for the use of the website and its content by any of its users that does not comply with the laws in force, except in cases of wilful misconduct or gross negligence. In particular, the user will be the sole party responsible for communicating incorrect or false information and data, or data relating to third parties without their consent, as well as for any incorrect use of them.
3. Any material downloaded or otherwise obtained through the use of the service is at the user’s discretion and risk; therefore, any liability for damage to computer systems or loss of data resulting from downloading lies with the user and cannot be attributed to the operator.
4. The operator declines all liability for any damage arising from the inaccessibility of the services on the website or from any damage caused by viruses, damaged files, errors, omissions, service interruptions, deletion of content, problems related to the network, providers or telephone and/or telematic connections, unauthorised access, alteration of data, or the failure or defective operation of the user’s own electronic equipment.
5. The user is responsible for safekeeping and correctly using their personal information, including the credentials that give access to reserved services, as well as for any harmful consequence or prejudice that may arise for Sotto i Limoni or third parties as a result of the incorrect use, loss or theft of such information.
6. The operator has taken every reasonable precaution to prevent the publication on the website of content and images that may be considered detrimental to decorum, human rights and the dignity of persons, in all possible forms and expressions. In any case, should such content be considered offensive to religious or ethical sensitivities or to decorum, the user concerned is kindly asked to inform the operator, who nevertheless warns that any access to content considered offensive or harmful takes place at the user’s own unquestionable judgement and under their sole and personal responsibility.
7. The operator has also taken every useful precaution to ensure that all information on the website is correct, complete and up to date. However, the operator assumes no responsibility towards users for the accuracy and completeness of the content published on the website, except as otherwise provided by law. If a user finds errors or out-of-date information on the website, they are kindly asked to inform the operator by writing to the e-mail address: info@sottoilimoni.com.
Art. 5 – Exclusion of liability
1. As indicated above, the operator carries out the care and maintenance of the website and its content with the utmost diligence; however, it assumes no responsibility for the correctness, completeness and timeliness of the data and information provided on the website or on the websites linked to it. Any liability for errors or omissions arising from the use of the data and information on the website must therefore be excluded.
2. The operator declines all liability, including for the presence of errors, the correction of errors and the responsibility of the server hosting the website; nor is it responsible for the use of the information contained, or for its correctness and reliability. In no case, including negligence, will the owner be liable for any direct or indirect damage that may result from the use of, or the inability to use, the materials on the website.
Art. 6 – Limitations on the provision of the service
1. The operator cannot be held liable for damages resulting from the failure to provide the service due to the incorrect or failed operation of electronic means of communication for reasons beyond its foreseeable control. By way of example, but not exhaustively: the malfunction of servers and other electronic devices, including those that are not an integral part of the Internet network; the malfunction of installed software; computer viruses and the possible presence of viruses or other harmful and damaging computer components; as well as actions by hackers or other users with access to the network. The user therefore undertakes to hold the owner harmless and indemnified from any liability and/or claim in this regard.
Art. 7 – Links to other websites
1. The website may contain hyperlinks to other websites that have no connection with it. The operator does not control or monitor such websites and therefore does not in any way guarantee their content or their management of data. The user must therefore carefully read the terms of use and privacy policies of the third-party websites visited, as these terms of use and the privacy policy refer only to this website.
Art. 8 – Links on other web pages
1. This website can also be reached through third-party websites that carry a link or banner to access it.
2. Activating links to this website on third-party websites is possible only with the operator’s prior consent and authorisation, which may be requested by contacting the operator at the address above, or by writing to the e-mail address: info@sottoilimoni.com.
3. The activation of unauthorised links will entitle the operator to act for the immediate deactivation of the unlawful links and for the possible recognition of the related commercial practice or unfair competition, or any action to the detriment of the good name and reputation of the operator, its services and the companies of the same group. The activation of deep hyperlinks (such as deep frames or deep links) to the website, or the unauthorised use of meta-tags, is in any case prohibited.
Art. 9 – Trademarks
1. All trademarks and distinctive signs on the website, including those relating to the individual activities carried out by the owner, belong exclusively to the owner or to the companies connected to the owner.
2. The owner has the right to make exclusive use of the above trademarks. Therefore, any use that is not permitted, not authorised and/or not in accordance with the law is strictly prohibited and entails legal consequences. It is in no way permitted to use such trademarks and any other distinctive sign on the website to unduly take advantage, even indirectly, of the distinctive character or reputation of the owner’s trademarks, or in such a way as to harm them and their owners.
3. The domain sottoilimoni.com, as well as its various variants and subdomains, are owned by the owner. No use, even indirect, is permitted without the specific written authorisation of the owner or owners.
